SEGURO DE INCLUSIÓN EN LAS RESERVAS VIAJES COMBINADOS


En lo que respecta a nuestro seguro de inclusión, dicho seguro incluye exclusivamente a aquellas personas que tienen su residencia y origen del viaje en España o Portugal.


CAPÍTULO I (Obligaciones de información y contenido del contrato de viaje combinado), Artículo 153 (Información precontractual.), punto 1, apartado H:


"1. Antes de que el viajero quede obligado por cualquier contrato de viaje combinado u oferta correspondiente, el organizador, y también el minorista, cuando el viaje combinado se venda a través de este último, proporcionarán al viajero el formulario con la información normalizada relativa al viaje combinado que figura en el anexo II, A o B, así como la siguiente información que resulte aplicable al viaje combinado:

"h) Información sobre la suscripción de un seguro facultativo que cubra los gastos originados en caso de que el viajero decida poner fin al contrato o los gastos de asistencia, incluidos los de repatriación, en caso de accidente, enfermedad o fallecimiento."


Dicho apartado hace referencia a la obligación de informar al cliente la posibilidad de contratar un seguro, no a la obligación de incluir un seguro en el viaje, es decir, el cliente tiene la facultad (opción) de contratar o no con la agencia un seguro. La agencia tiene la obligación de informar que es recomendable que el cliente contrate un seguro que le incluya, al menos, temas como repatriación,... lo que básicamente es el seguro de inclusión.


Una vez que la agencia informa al cliente sobre la recomendación de contratar un seguro para el viaje, ya es el cliente quien puede contratar un seguro con la agencia, o que lo contrate el directamente con quien quiera.
